CONDITIONS OF SALE
These General Conditions of Sale are drawn up in Italian and govern the offer and sale of products and / or services on the website www.coccoy.it as well as, for what is not provided here, in the provisions of the Consumer Code and Legislative Decree no. Lgs. N. 70/2003 and of the civil code.
The products and / or services purchased on the site are sold directly by Fashion Bed, with registered office in Italy, Via Cà da Pì 1 (Bergamo); CF and PI 02039670167.
A. Information regarding the conclusion of the sales contract
- These general conditions of sale are an integral and essential part of the purchase contract concluded between you and Fashion Bed. Your electronic order submission implies full knowledge of these General Conditions of Sale and their full acceptance.
- If you do not agree with one or more terms contained in these General Conditions of Sale, please refrain from making purchases on Coccoy shop.
- When proceeding with the transmission of the order, you will be warned that such forwarding implies the obligation to pay the indicated price.
- The purchase contract is to be considered concluded when Fashion Bed receives your order electronically, after verifying the correctness of the data contained therein.
- Once the purchase contract is concluded, Fashion Bed will process your purchase order by sending an email containing the order summary. However, this email does not constitute automatic acceptance of the order itself. In fact, Fashion Bed reserves the right to refuse orders from customers with whom there is an ongoing dispute regarding the payment of a previous order, who do not give sufficient guarantees of solvency, or which are incomplete or incorrect, or in case of unavailability. of products. In these cases, Fashion Bed will inform you by e-mail that the contract is not concluded and that Fashion Bed has not carried out your purchase order.
B. Prices
- All prices published on the Site are expressed in Euros and are inclusive of VAT, but do not include customs taxes, import taxes, customs brokerage fees and commissions, if applicable based on the destination of the order. In fact, for some destinations, upon arrival at the border of your country, the content of the order may be subject to customs duties (which may include taxes, duties, handling costs, remuneration of customs brokers, etc.), the payment of which is at your expense, as the customer receiving the order.
- Fashion Bed reserves the right to change the price of the products at any time and also, possibly, several times during the same day, it being understood that the price charged to the customer will be that indicated on the Site at the time of the order and that any changes (increase or decrease) subsequent to its transmission will not be taken into account.
C. Methods of payment
The payment of the Products purchased on the Site can be made using the payment methods described in the following paragraphs. Some payment methods may not be usable due to the type of Product purchased and / or the method of delivery or shipment. The payment methods actually available to the customer in relation to the individual Product will be specifically indicated during the purchase procedure.
1) Credit card
Payment for Products purchased on the Site can be made by credit card directly through the Site. The credit cards accepted by Fashion Bed will be specifically indicated on the payment method page. For payment using some credit cards, an additional fee may be required. The request for this contribution and the exact amount of the same will, if due, be clearly and specifically indicated on the page for choosing the payment method during the purchase procedure.
- In the case of payment by credit card, at the same time as the conclusion of the contract, the issuer of the reference card will authorize only the commitment of the amount relating to the purchase made ("Authorization"). The Total Amount Due in relation to the purchased Product will actually be charged to the customer's credit card at the time of shipment of the purchased Product.
- In all cases of termination of the contract and consequent cancellation of the order before the actual debit on the customer's credit card, Fashion Bed will request the issuer of the reference card to release the amount committed through the banking systems. The release times depend exclusively on the credit card issuer and, for some types of cards, they can reach their natural expiration which is normally 24 days from the date of the Authorization.
Once the issuer of the reference card has been requested to release the amount committed, in no case Fashion Bed can be held liable for any direct or indirect damage caused by the delay in the release and / or the failure to release the amount committed by part of the banking system.
- If, after the actual debit of the total amount due on the customer's credit card, the contract is terminated, with consequent cancellation of the order, Fashion Bed will re-credit the total amount due without undue delay and, in in any case, within 14 days from the termination of the contract.
- At no time during the purchase procedure is Fashion Bed able to know the information relating to the customer's credit card, transmitted, via a secure connection, directly to the card issuer's site. No Fashion Bed computer archive stores such data, except, limited to the data relating to the card holder, the case referred to in the preceding paragraph.
2) Paypal
- The payment of the Products purchased on the Site can be made through the PayPal payment solution, based on the terms and conditions of the contract agreed between the customer and PayPal. In the case of payment by PayPal, the amount relating to the purchase made will be charged by PayPal immediately, at the same time as the conclusion of the contract.
- In all cases of termination of the contract and subsequent cancellation of the order, the total amount due will be simultaneously re-credited to the customer's PayPal account. The methods of re-credit on the payment instrument connected to the PayPal account depend exclusively on PayPal. Once the amount relating to the purchase made on the PayPal account has been credited, in no case Fashion Bed can be held responsible for any direct or indirect damages caused by delays in the actual crediting attributable to PayPal or the banking system.
- The data entered on the PayPal site will be processed directly by the same and will not be transmitted or shared with Fashion Bed. Fashion Bed is therefore not able to know and does not store in any way the data of the credit card connected to the customer's PayPal account or the data of any other payment instrument connected with this account.
D. Delivery methods
You can choose to have your order delivered to the address you prefer, or to your office.
Once the order has been placed, it is no longer possible to change the shipping address.

E. Withdrawal rights
- As a customer, you can withdraw from the purchase contract concluded with Fashion Bed without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased in the manner indicated below.
- Before the expiry of the withdrawal period as determined above, you can make the return request directly from the Coccoy shop by filling in the request in the contact section and forwarding the return request to Fashion Bed. Alternatively, by another explicit declaration of your decision to withdraw from the contract, to be communicated to Fashion Bed through an email addressed to info@coccoy.it which includes the details of your purchase, the date on which it was ordered or received and the your name and address.
- As a Customer, you must return the goods or deliver them to the third party authorized by Fashion Bed to receive the goods, without undue delay and in any case within fourteen days from the date on which you notified Fashion Bed of your decision to withdraw from the contract. The deadline is met if you send back the goods before the expiry of the fourteen day period.
- Shipping and return costs remain the responsibility of the buyer, except for current promotions specified on the coccoy.it site at the time of purchase.
- After returning the products, Fashion Bed will make the necessary checks regarding their compliance with the conditions and terms indicated in this section.
- If the right of withdrawal is exercised following the methods and terms indicated in this paragraph, Fashion Bed will refund you any sums already collected for the purchase of the products.
- Whatever the payment method you use, the refund is activated by Fashion Bed in the shortest possible time and in any case within fourteen (14) days from the day on which you notified Fashion Bed of your decision to withdraw from the contract. Fashion Bed may withhold the refund until it has received the products, or until you have demonstrated that you have returned the products, whichever occurs first.
- Fashion Bed will make the refund using the same payment method you used for the purchase of the returned products, even if a virtual and / or disposable credit card has been used. For legal reasons Fashion Bed will in no way be able to make a refund on a credit card other than the one used for the purchase, except in the case in which the credit card itself has expired in the meantime: in this case you can send a e-mail to info@coccoy.it to agree on the most appropriate means of reimbursement.
F. Purchases on the Site
- The purchase of the Products on the Site is allowed only to those who have reached the age of 18.
- The purchase of the Products on the Site is allowed both to customers who have the quality of consumers and to customers who do not have this quality. Pursuant to art. 3, I comma, lett. a) of the Consumer Code, the consumer is the natural person who acts for purposes unrelated to any entrepreneurial, commercial, professional or craft activity carried out. The inclusion of the VAT number during the purchase procedure is considered to indicate that the purchase has been made for purposes related to the entrepreneurial, commercial, craft or professional activity carried out.
- The purchase of Products on the Site can take place with or without registration on the Site.
- Registration on the Site is free. To register on the Site, the customer must fill in the appropriate form by clicking on "My Coccoy".
Registering on the Site allows customers to carry out the following activities:
- consult the status of your order online and check the "history" of the orders placed (in particular by clicking on the number of each order placed, you can check the complete details of the order, including product details, the shipping address and 'billing address;
- follow the shipment tracking directly from the order history;
- manage your delivery addresses by speeding up the insertion of new orders;
- receive product offers.
Furthermore, by accessing your personal area ("My Coccoy"), it is always possible:
- manage information relating to your personal profile (in particular it is possible to change the password for access to the reserved area);
- change the data relating to the shipping or billing address and / or add new shipping addresses.
- The customer guarantees that the personal information provided during the registration procedure on the Site is complete and truthful and undertakes to keep Fashion Bed harmless and indemnified from any damage, compensation obligation and / or sanction deriving from and / or in any way connected to the violation by the customer of the registration rules on the Site or on the conservation of registration credentials.
- In case of violation of the prohibitions contained in the current article, Fashion Bed reserves the right to take all necessary actions to stop the irregularities, including the suspension of access to the site, the cancellation of the registration or the non-acceptance or cancellation of orders.
- The Site is constantly updated automatically in order to ensure maximum correspondence between the availability communicated by the suppliers and those indicated on the Site.
However, it may happen, also due to the possibility that several users purchase the same Product at the same time, that the ordered Product is no longer available after the transmission of the purchase order. In this case, without prejudice to the rights attributed to the customer by law and, in particular, by Chapter XIV of Title II of Book IV of the civil code, the customer will be promptly informed by e-mail and will therefore be entitled to immediately terminate the contract, without prejudice to the right to compensation for damage, pursuant to and by effect of the provisions of art. 61, IV and V paragraphs, of the Consumer Code. The customer who has already made payment (see the Payment Methods section) will be promptly refunded the total amount paid, including delivery costs and any other costs incurred, in relation to the order itself ("Total Amount Due" ).
